Foreigners who remain in South Africa beyond the expiry date of their Temporary Residence Visas are categorised by South African law as ‘illegal foreigners’. The law imposes on such persons a duty to leave South Africa unless they are specifically authorised to remain by the Department of Home Affairs (DHA).

Persons who fit this category are often dubbed ‘illegal’ and, failing their departure from South Africa, are required to present themselves to the DHA to submit a Good Cause Application as to why they overstayed their Temporary Residence Visas and to apply for a renewed and valid Temporary Residence Visa.

Overstay Appeals

As mentioned above, foreign persons often overstay the validity of their Temporary Residence Visas, resulting in several legal ramifications. Upon departure from South Africa after the expiry of their visas such persons are served with a Declaration of Undesirability which effectively bans them from re-entering for an extended period of time (this ranges between one and five years).

Foreigners wishing to return to South Africa before the expiry of their ban are required to submit an application to the Minister of Home Affairs to request that the Declaration of Undesirability be lifted. It should be noted that, in order to succeed, such applications must be meticulously prepared to outline the particular reasons that led to them overstaying their Temporary Residence Visas.
